There are basically two big camps in the immigration reform debate and each has subsidiary interests that diverge in important respects from the bigger grou[. There is the pro-immigration camp which generally favors immigration reform proposals introduced over the last few years. Within the pro-immigration camp, there is the labor left which is in favor of legalization but balks at provisions that would provide temporary or permanent visas to workers that might come in the future. In the anti-immigration camp, there is the major group which opposes any form of legalization and is of mixed thinking on future worker provisions....

Following are my case details -
Visa and I94 expiration date: 12 Sep 2009
Filed extension: 11 Sep 2009
Extension denied: 18 Nov 2009
Left US: 15 Dec 2009
Refiled H1 Visa: 15 Dec 2009
Visa apporoved: 22 Dec 2009
What should my answer for following question in DS-156 as I left US within 30 days of receiving the denial letter?
Have you ever violated the terms of a U.S. visa, or been unlawfully present in, or deported from, the United States?
Kindly suggest.

Ask them to re-apply PERM as soon as possible.Its faster to re-apply then get the auditted PERM outcome...

Online status says my applications were recd on Oct 2/ 2007.
My reciept notices show the right date in August.

Also I would like to see a comprehensive idea posted from IV and drive our members to upvote the idea so it will be on the top as top rated , most commented idea.
Whether DHS will follow through or not at the least we will be educating more people on our legal immigration woes.

USCIS has announced that beginning October 1, 2010, domestic offices and U.S. territories, including the U.S. Virgin Islands and Guam, will no longer be accepting cash payments. Other payment options will include money orders, credit cards, and checks (including personal checks).

Hi,
My I-140 was filed at VSC on 7/7/07. It was later transferred to TSC.
In this case, would I base my I-140 processing time on VSC which is stucked at 04/01/2006 or TSC which is at 08/15/2007?
I was hoping the later but I just called USCIS customer service and they said that A) it is based on WHERE YOU INITIALLY FILED and B) my application will eventually be sent back to VSC. I appreciate if someone can verify this. Thanks.

1. I am planning to work with a new employer on EAD. As i have heard in order to file AC21 the employer letter should present same job description as previous. I would like to know what are the other things we need to consider in order to be safe while filing AC21.
2. I requested my current employer to provide the copy of Labor certification that was filed for me. I received the following response from XYZ Company Inc., DOES NOT RELEASE COPIES OF THE LC, AS IT IS OUR APPLICATION WITH THE DOL FOR A POSITION NOT AN EMPLOYEE AND IT IS CONSIDERED PRIVILEGED AND CONFIDENTIAL.

NO, a 3-year extension is possible after I-140 is approved. In your case you will get a one-year extension based on PERM which is pending for 1 year, or is approved by the time you need to file for H-1B extension.

I have filed 140 /485 concurrent on Aug 3rd and haven't received any receipt. Have opened SR , Sent FAX ..but no updates.
As per the nrew rule implemented on July 16th , All the previously approved labor will expire on Jan 12 2008.
If for any reason we don;t receive receipt , what happens to labor.. Are we back to square one ..
If anybody in simiar situation... Please reply.

I am currently with Wipro. I was working in india and i came onsite thorugh Wipro itself on H1B . Right now i have couple of offers with other companies and i would like to resign wirpo. When i want to resign wipro asks me to pay 5 lakhs + H1B change ($2000) . Can you please let me know how to proceed with this ? The reason why they are asking me to pay 5 lakhs is they want me to come back to india and work for 6 months(which does not make sense) when i have couple of offers here .
Is it legal for companies to charge this much of money ?
Has anyone from wipro come onsite and resigned here ?
