After that 485�s will be processed by PD and not by RD.

Hello,
I am currently on L1 individual extension in US.
I will be traveling to India shortly for 2 week vacation. I will be attending the visa interview for stamping at Chennai before my return to US.

Can someone tell me/share what are the chances of visa getting stamped? What kind of questions to expect?

I hope that since i am already on extension in US, visa stamping is just a formality at US embassy?

Please let me know ASAP.

Please correct me if i am wrong.

WH-4 Time line is within a year, means if betrayel/non payment happened with in a year from the date of reporting it will be investigated, and YOU CAN FILE WH-4 FROM OUTSIDE OF US ALSO, if your consultant company sent you back with fake commitments.

But not sure if your h1 still have time, after DOL complain, you can transfer it or not??

Anyone has any idea???

This could have been usefull to ariesbkk18.

My wife's H1B got approved earlier this week through company A. Company B also made an offer last month but they are still working on the H1B visa issue with the attorney.

So, my question is if this company (B) files H1B now, then it should be a "transfer (not subject to quota)" or "new petition (subject to quota)"?

I think she is already on H1B as of today with COS effective immediately approval so any new employer can only apply for transfer and they don't need to ask for COS. We will not have pay-stubs to transfer as we are still to receive the I-797 copy and apply for SSN so that payroll can be run for her.

Please let me know if anybody has got any insight on this situation. Very much appreciate your time.
