Hi,
My employer filed H1B transfer in Feb 2009. however he could not receive RFE letter with in time on mail and only received after RFE submitted date was expired which is May 25th, 2009
In jun1 1st week , he filed for the RFE extension for the stated reason and also refiled H1B to make sure that I should be in valid H1B status in case of first H1B denial in mean time
Employer submitted all the documents related to RFE on June 20th and it got approved on jul 1st.
What are the best options for H1B refiling case
in case if it is denied, will it super impose the original H1B approval ?
is it good idea to cancel/revoke pending H1B refiling case ?

HI,
My wife is going to India and She has to get her H4 stamped again(I am on H1 and received my next 3 year extension and so did my wife).
My parents are also planing to visit me. Should I book my wife's appointment along with my parent's appointment , or should I book 2 different appointments one for my wife and one for both my parents.

Desi employer is not paying for the PTO that I used about 4 months ago. since I'm leaving them in about 2 weeks, they've been delaying this and not paid my PTO. I sent 200+ emails to them.,
I have emails from Employee rerlations managers of the company confirming my available hours and telling me that I would be paid. then endless chains of emails....
I intend to take them to court over this issue. Just wondering if emails in this regard would be sufficient proof of my eligibility and their reluctance for paying my PTO. Is PTO treated same as salary?
I actually went on vacation after confirming with HR that I had PTO in my account. Even after coming back I got emaisl from them that I'll be paid..
Nothing yet after 4 months.
Any suggestions on how to take legal help on this. I've been workign for them for the last 4.5 years.

Reform Immigration For America reports that 500,000 people participated in May Day protests at 80 events around the country. I was attending my 20th law school reunion this weekend in Chicago so took the opportunity to attend the event in the Windy City. The crowd was enthusiastic with lots of signs criticizing SB1070 and calling for immigration reform. And lots of US flags .

Just came across GAO's( General Accountability Office) recommendations to make changes in H-1B program. Eventhough they talk mainly about Staffing Companies and increased employer accountability, there seems to be a mention regarding the H1B extensions beyond 6 years with simultaneous application to green card. Eventhough not stating in exact words, it seems to hint to the congress to seriously relook at H-1B extensions beyond 6years and also regarding cap exempt Visas and supposedly how easy it is to get them. Looks like with the economy being how it is, Congress might use this report to jump in and bring some unfavourable changes. Any thoughts on this...?

I was with ABC consulting company and had applied for GC (and got perm and 140 approved). My contract with client ended. Though ABC were good but they could not get me a project so I had to shift to another company. I talked to ABC to get my GC proceeding with extra cost. They said (and attorney also) said my 485 has been filed. As the ABC had changed their name also, as notification for I-140. They also insisted to join back.
My new company layoff quite a lot of people. Needless to say, me also. Now my easy option is to join them back, but is there any possibility that to make me continue to work for them, they can do mess up in GC process?
May be question is quite personal, please suggest whatever cmes to your mind.

Last week, the strong-arming continued during the most important debate the Congress has faced yet -- the discussion about the Iraq war. Democrats initially said they would allow Republicans to propose one alternative to the resolution denouncing a troop buildup but, days later, they thought better of it.
And yet, significant numbers of House Republicans have voted along with Democrats on the legislation passed so far -- a fact that somewhat mutes criticism about iron-fisted tactics.
In the first weeks of the new Congress, however, Democrats bypassed the usual legislative committees, refused to allow any amendments and took their agenda straight to the floor for passage. They said they needed a clear path to pass a handful of popular measures that were the basis of their successful November campaign, including expanded money for stem cell research, an increase in the federal minimum wage and implementation of recommendations of the Sept. 11 commission.
Democrats said they would impose "regular order," the rules that permit the minority to participate more widely, in short order.
But even after passing their domestic agenda, Democratic leaders have continued to marginalize Republicans, preventing them from having a voice in legislation such as a bill to withhold federal pensions from lawmakers convicted of ethics felonies and a $463 billion bill to fund the federal government for the rest of this fiscal year.
Last week's debate on the Iraq war, culminating in its passage Friday by a vote of 246 to 182, was conducted under a "closed rule," which means Republicans could not offer alternatives. "I understand what they did on their agenda," said Rep. Mike Simpson (R-Idaho). "But to do a closed rule on something like this is a huge mistake. We're talking about war and peace. You don't play politics with war."
While they did not allow amendments on the Iraq debate, the Democrats gave every member of the chamber five minutes to speak on the resolution -- an unprecedented amount of debate on a nonbinding resolution, according to Thomas E. Mann, a scholar at Brookings Institution. He said that is more than the Republicans offered Democrats when the GOP passed a resolution last spring supporting the war in Iraq.

If you engage in employment, including self-emplyment outside of your H1 employment you violate the terms of your H1 status. If USCIS becomes aware of such employment, they will find that you gave up H1 status.

My current H1 expired on 7/9, I applied h1 extension (with approved I140) on 6/30/10 with client letter (with no end date) and other documents. I got approval last week, they approved my petition from 11/18/2010 - 11/17/2011. 10th year extension.
1. What is my status between 7/10/10 - 11/17/2010?.
2. Do i need to inform USCIS?
3. I expected 3 years, but I got only one year.
Is anybody faced similar situation or any suggestion.

This question is to all attorneys for their input on whether there will be another window (or something called pre-filing) for all GC applicants waiting for file their I-485. It would be great if there could be 'pre-filing' with eligibility for EAD since H1 renewals are becoming tougher by the minute.
Attorneys please add your comments if there is a probability of this happening and if not is there any way we can request USCIS to consider?
