Friends I need an opinion regarding my wifes situation. She is currently on H4. She was on H1B before some time back which she had stamped in India itself. That H1B expired. She moved back to India. After 5 years now she applied for new H1B and got it in the quota. When the dates advanced we applied for her EAD. We were hoping to get it in 60-70 days. Now its been 75 days at TSC and no signs of approval. She had job offer based on EAD since we thought might as well use that. Now we are thinking she should get her H1B stamped because we dont know when her EAD will get approved. For that do you think going to Canada for stamping is safe. She has a Bachelors degree from India. Or do you think going to India only is thesafe option. Mainly I asked was I did some search and found out that its safest in Canada if you have US/Canadian Degree. Is that true or I am wrong and its safe for everyone. Thanks.

a.) DO you need latest paystubs for filing for 485.

Suppose, i am working for company A and company B has filed for my GC, then how can this be provided.

b.) Even if i am working for company A, do i still need pay stubs or will a letter stating that "this job is available for the immigrant" suffice.

i have been offered a job at my current research centre where i worked as a student. I want to go back to my home country. The job can be done online and does not require physical presence in the USA. Will i still need an OPT? or can they employ me as an international worker? if they wmploy me as an international consultant then what are the ramifications for teh company? wht is the legal procedure? will they have to pay taxes more etc?

Thanks to IV for making the multi year EAD/AP happen. Since USCIS might or might not announce this, I want to track when people start getting these multi year EAD/APs. Anyone in the IV community got one of these yet?

Not yet....you know they are very lazy to implement it esp. good one's that people are benefited..

Hi,
I have applied for COS from L1-B to L1-A and received an RFE which we have responded to.
The application is still pending with USCIS, while my I-94 is expiring on 07/31

What will happen if I do not receive decision before expiry of my I-94? Will I be out of status after the I-94 expiry date.
I have my I-485 pending as well (I-140 approved) and have EAD but not used.

I am currently in the US on H1B and want to pursue higher studies. Can someone please let me know the supporting documents that are required for COS.
Do I need my original
1. Transcripts/Marksheets
2. Experience/Relieving Letters
3. Tax Returns
4. Bank Statements for 6 months

I am asking this because i dont have these documents with me right now and I want to apply for a Change of Status immediately. I know that the above are all required to file for a F1 visa

Would appreciate a response.

My h1b expires of 09/30/2010.
my drivers license expires on 5/31/2010.
I have ead that expires in jan 2011.
my h1b extension will be filed around june 2010.
can I use ead card to renew my drivers license till jan 2011.
around jan 2011 I could use extended h1b to renew my drivers license.
Can I do this. All I want to use my EAD card is for drivers license renewal.

HI,

I have an H1b approval notice but as it clear the duration of the visa validity starts in October, today being 27 june and three months away from start of visa duration can i travel to India next month ( july) and be back in August as i am still on OPT and working full time in America now. I have got an oppointment with a consulate in India. Once i have got a stamp on my passport will i be permitted to enter back immediately or only in october, i need to make decision to travel now or later as if i am allowed back immediately it will affect my work.
